Going to decide to suppress the DNA match or prevent or preclude the prosecutor Bill Thompson from saying we found a knife sheath at the scene of the crime we extracted a DNA sample from the button clasp we ran analysis on it and ultimately we made an arrest in this
Case we took a sample of DNA from the defendant we ran analysis on that got an Str strr profile compared it to the original Str strr profile and it was a solid want you to listen to this guy it is the defendant’s DNA he’s going to let that
Proceed so my contention is what is the point of all this if that’s going to be the case is it just an and Jay and the defense team setting this up for an appeal because there this is a remember judge judge has said here this is a matter of first impression Idaho meaning
It’s never been dealt with a Idaho so it’s a first impression so in that sense in his opinion it’s an important matter because this you know everything else that follows from this related to DNA for any other case is going to look to this case for some guidance so it’s a
Matter of first impression but I would still argue it’s a farce it’s an absolute farce yeah it’s a matter of first impression judge judge and you could really set the tone as a matter of first impression by you know ruling that this is already in my opinion you should have
Ruled this as in inadmissible the DNA and tros agrees I’ve got tros up here tros does a good job here so you can go to this related to this hearing in my opinion but you know Trey go is a is a uh judge judge fan you know he
Thinks he’s a great judge he she he thinks he’s being fair and balanced and a judge judge I I I will contend I will always contend judge judges milk toast okay and this case requires more than milk toast all right it really does the the the uh prosecution backed by the
FBI is running circles around him and they’re I mean they’re taking advantage of him I don’t believe he’s a bad person okay but I believe he’s a naive person and he’s being taken advantage of by the back of the room bullies here and tros you know know fails to see

What does the defense want from this what do I mean by this okay let’s take a look at our cheat sheet once again all right this is the DNA cheat sheet all right I list everything that was done by the state related to the DNA
Here this is in a previous video and a previous blog post what’s applicable here though is the Alpha and the Omega of this list all right the alpha the beginning and the Omega the end and the loop back from the end from the Omega the end to the alpha the beginning okay
That’s this whole process if you look if you look at this a flow chart it’s flowing downward this way you get to the end and you tie it back to to the very start okay so what’s the very start the Idaho State Police lab performs Str Str analysis on the DNA
Sample extracted from the knife sheath to develop a profile okay the developed Str Str profile they allegedly developed an Str strr profile as in explicable as that seems and as implausible and as impossible as that seems according to Bruce ball whose guidance is not to do
This is uploaded because of its an low copy number sample all Trace touch DNA is is uploaded into cotus to determine if there are any matches with known Andor unknown offenders the creator of cotus is Bruce budall who was formerly with the FBI okay so here we have it steps one
And two the state alleges that they developed a a reli ible full reliable St profile from this low copy number sample against Bruce Ball’s guidance Bruce budall is the Godfather of DNA okay he used to work for the FBI crime lab he goes way back when DNA came
Into the realm okay he’s at the center of this he’s the Godfather of it he’s the experts expert all right and his guidance all along has been you should not try to develop a profile um for matching purposes at least I mean you can develop a profile
Enough to there’s other tests that you do on a profile to determine whether it’s male or female but uh other than that you shouldn’t do it for matching purposes because it’s extremely unreliable and unten and yet law enforcement continues to push this and I would argue they
Continue to push it because they’re not acting in good faith they’re pressured to close cas and so they pre their pressured to to take shortcuts accuracy be damned or potentially putting an innocent person behind bars be damned Bruce budall know knew this and knows this nonetheless the
ISP claims that they developed a full reliable profile from this and then the end process of all of this the IG everything the end process is that on November I mean I’m sorry on January 5th a warrant is issued for the defendant’s DNA after he’s been arrested
Five days after he’s been arrested and a buckle swab is taken and analyzed and the SDR profile de developed from that is compared to the SDR profile developed from the knife sheath and it is determined the DNA on the knife sheath is 5.37 ocon times more likely to be the
Defendants DNA than anyone else’s DNA this is at the heart of it folks first question which is which is the title of this blog post is this in dispute in other words they took this St Str profile developed from the arrest warrant when they extracted his DNA from a buckle swab and
Routed it back to the beginning and compared it to this Str profile and they said it’s a match does the defense dispute this that is what is getting to me right here are they disputing that that isn’t Brian’s DNA at all that he wasn’t there no they’re not they’re not disputing that
Why why aren they going after that that makes me wonder about an Taylor does the defense dispute it I see no indication here in any of this that the defense disputes this and I submit to you if the defense does not sub does not dispute this what
Is the point of arguing how we got to this point now the judge uses a lot of case law in his order here okay so the order addressing IGA IGG DNA by the judge issued 1025 2023 or published 20 1025 2023 right here he goes through a bunch of case
Law to uh you know show all the precedent that’s out here related to this and what other courts have decided in other states related to it a number of the cases that he presents in support of having to reveal the IGG process are it has nothing to do with IG or
Anything because if his DNA and and if the defense believes that his DNA is not even on the sheath that is not his DNA and and and they’re not disputing that what the hell yes Karen you got it right right he needs a new
Lawyer I I don’t you know I used to be on an Taylor’s bandwagon and everybody was on an Taylor’s bandwagon I’m not anymore whatsoever she should be attacking what they sent to get the IG she should be all over is that his I his um is
DNA they got that’s where they have to attack I don’t get it and and in my experience with uh what do you call public defenders is not good I mean the guy was in on it he was in on it with the prosecution and I didn’t learn it until
The end and I learned the hard [ __ ] way and I just don’t get it they need to be attacking that that isn’t even his his his uh DNA to begin with to send in to get IG G and they’re not doing that individuals who were clearly guilty folks they were clearly
Guilty I mean in those cases once again this was not in dispute taking the Buckle swab once arrested and comparing it back to the and getting an Str strr profile from that and comparing it back to the S strr profile that the crime scene that was developed from the DNA
Found the crime scene in those cases that’s not in dispute and in fact I would go a step further in those cases all of them are not low copy number trace touch DNA by the way they’re all biological uh DNA or biological fluid DNA which is much more
Robust um but they they’re not arguing in those cases that there’s not a match here they’re arguing we don’t like how you got to the arrest of the client to begin with to get you know the Buckle swab ultimately to get the this to get this match of Str profiles that’s what
They’re arguing they’re arguing a technicality I’m not for that folks if you if we want to as a society address this whole IGG process and that there should be enforceable codified rules and laws related to that ver verus versus just gu by the Department of Justice I’m
For that and there are avenues for that and those Avenues should be taken and advocated for but I am not I will never advocate for somebody going free on a technicality knowing that they’re guilty otherwise um you know to to uphold rights uhuh I’m not willing to make that utilitarian
Compromise basic moral values folks called utilitarianism utilitarianism say it’s just a matter of numbers I’m not willing to make that argument I’m not willing to go along with okay Pebbles um that’s what I’m saying is that’s what they have to fight is that is that they’re saying
That that was his his DNA to begin with that’s what they had to fight that’s what they have to fight not the IG not they have to attack that they found his DNA a partial touch DNA that I can get by shaking a hand and somebody else touching it
That’s what they have to fight that it was that it was it wasn’t his DNA to begin with period I don’t think they are Pebbles they’re fighting the IGG yeah exactly you know that’s that’s what I’m saying they have to attack the the very start of it and they’re not doing that
And that’s what and that’s what this uh guy is saying here with that if this is the defendant’s DNA and the defense is not arguing that and they’re not disputing that then I’m not for it I’m not for this IGG argument I’m not as as I think
It’s I think it’s valid I mean I think it’s valid their criticisms of the IG process and how it’s been used in this case how it’s being used in other cases and it’s being pushed to be used in other cases all of that is valid what
Leah Lin has said at her blog all of it is extremely valid and I am for advocating for enforceable codified laws related to this process absolutely I don’t want the courts determining this I want the legislators determining this this needs to be legislated and it needs to be legislated
In a fair and balanced way and not onerously influenced by the law enforcement Lobby because it law enforcement Lobby is significant on our lawmakers they get their way most of the time so is judge judge going to rule well you know tros covers it here okay I don’t I’m not going to replay
Tros go and watch it but effectively what what w what transpired during this Zoom meeting was judge judge sent set a deadline of de de December 1st for the state to turn over everything related to the IG process and the development of the S&P profile and we learned in this that there’s two
Profiles involved maybe there’s more than two profiles involved I think this is people running with this and saying oh two profiles is uh you know I think that may be just part of the process and the defense knows that um that when you upload it into a database the
Profile gets massaged and that’s some of the issues related to this whole IG process right I mean if you start massaging things well then you go down a road to you know subjectivity rather than pure scientific objectivity but we already know from CC more for example that there is subjectivity involved in qualitative
Processes involved in the IGG process it’s not just purely a quantitative scientifically objective process and I know judge judge I think is under the assumption that it’s just purely scientific and therefore objective but it’s not there is there is subjectivity involved in this there is choosing using your mind and the
Algorithms of your mind and all the biases incumbent upon those algorithms of your mind to determine which have to choose to develop family trees because there’s innumerable paths you can take and as we saw with CC Moore in the one case she took a path in a family tree that led to
What she thought was you know the match submitted to law enforcement it turns out when they investigated a further that was not the match so she had to go back to the drawing board and she took an entirely other path and that old me L letter her to another suspect that was a
Lead and that one ended up being the one see I’m going here this is this is not just purely scientific quantitative objectivity which is rarely if ever wrong it can be wrong and there needs to be checks and balances and rules and laws enforceable related to that because
It can be wrong because there can be human error involved in what is yes a scientific process but does involve human subjectivity and human judgment despite all the and remember an algorithm as well folks is only as good as its human maker right I mean our biases and flaws enter into
Algorithms so if aam for example says they want to make this purely a scientific process meaning purely run just by algorithms with no human judgment whatsoever ultimately I’d say [ __ ] the fact that humans created that process that does that means that there is human bias involved in the development of the
Algorithms humans subjectively determine what what will be included and what won’t be included in an algorithm how the algorithm is constructed so there’s always going to be human bias and error involved in that process algorithms are human they’re extensions of the human mind and thus are subjected to
Biases anyway so getting back to square one so judge judge says you have to turn over all this information by December 1 related to aam’s development of the S&P and related to um the FBI’s all the processes that they took in developing the family tree to get to the
Defendant’s father okay because remember the IGG process resulted in them matching the DNA matching finding the defendant’s father well wait a minute finding the defendant I’m sorry so they they ran the uh analysis through the through IGG after the Str profile was determined not to be matched to any um
Offender and they got to the suspect and so that’s when they collected the trash from the house to see if they could get a match and instead they matched the trash from the house to the suspect’s father versus the uh versus the suspect but they then had enough for the arrest
And I take exception with judge judge um in this that uh that this was not used for probable cause for the arrest I I believe it is but apparently that’s a Mot point now so if the defense thinks that’s their endgame here that they’re going to get the arrest thrown out
Because it was an unlawful arrest that’s apparently that door is closed so we’re we’re past that point some attorneys have told me that once the grand jury indictment came over that’s it that’s the uh the probable cause is no longer applicable and it’s the grand jury in indictment that rules
So the defense I don’t believe can argue that that the the arrest was unlawful and once again I go back to are they disputing that the DNA that the defendants DNA is a match with the strr profile originally taken from the knife sheath developed from the DNA taken from the
Knife sheath if the defense isn’t arguing that once again I’ll say what’s the point of this what’s what’s going to be their their defense here then if they’re not arguing that anyway here’s the farsal part once again folks all right Bill Thompson has said time in Memorial that the FBI does
Not have this information here we have to look at it again all right what part does judge judge not understand about this the genealogy conducted by this is Bill Thompson in his own words in a court document the genealogy this is in June folks June June the genealogy conducted by the FBI
Resulted in a lead that appointed law enforcement to the defendant that that’s disputable in my opinion but and yet we don’t have dates and times on any of this when any of this was developed but it’s disput it’s disputable but it did not result in the creation of many documents or records
Right there folks it did not result in the creation of many documents or records now believe him or not and I don’t believe him all right because I believe that all this could have been uh developed but they’re never going to turn it over because that’s their policy
Not to turn it over so their lie think this is probably a lie but you know judge judge would never think it’s a lie you have to trust because they all took Oaths these are individuals had nothing but the best interest of American citizen cens at heart right but it did
Not result in the creation of many documents or records much of the information relied on by the FBI was only viewed through the user portal in the publicly available genetic genealogy services and other investigative databases CC Moore I ask you what would you say about this CC Moore what would
What would you say about the professionalism related to this if this if this is true CC Moore if it’s true that they didn’t do any of this retain any documentation to support their case here what would you say CC Moore I’ll tell you what cc Moore would say nothing

Gotten that was the IG process because the IG process was the lead it was the lead to the suspect allegedly so it all stems from the IG so the IG is responsible for getting the arrest it tipped the scales the rest of the evidence per the probable cause
Affidavit for the arrest is crap I mean a judge would have to be insane to approve an arrest warrant based on that there’s no probable cause there from the other two things the cell phone you know appeared like it might have been turned off for two hours and there
Were pings somewhere in Royal Idaho at a certain time at you know 5:00 which was you know allegedly you know an hour after the massacre or thereabouts and then he was overseen on cameras at you know 2:44 in the morning and and pull pman what what that’s not probable cause you
Saw white car even if it’s an Elantra but you know you originally thought it was a 2011 2013 in the neighborhood no indication that it could be his car he has a car similar you know he has an a launcher but a different year model I mean that’s

Said I cannot and I will not allow these men to represent you something along those lines don’t quote me but it’s similar I can’t remember every quote from every person and little did the judge know three attorneys were working very hard behind the scenes because she has violated many public records laws
And she put the case Deets on this case on private and she made the records inaccessible to the public Richard Allen is going to either end up passed away or on appeal one day and Richard Allen’s attorneys are very intelligent men and they know they are up against some
